1. Definitions and Information about the Seller

1.1 Terms and Conditions – This document, which defines the general conditions, rules, and method of sales conducted by the Seller through the Online Store.

​1.2 Seller – Mainsoft spółka z ograniczoną odpowiedzialnością (limited liability company), with its registered office at ul. Szpitalna 8 lok. 6, Warsaw, 00-031, Poland. The company is registered in the District Court for the capital city of Warsaw under KRS number 0000886423, NIP (Tax ID): 5252855241, REGON: 388395271. The commercial activity and product showroom are located at: ul. Puławska 228, lok. U5, 02-661 Warsaw, Poland.

​1.3 Store – The online service operated by the Seller under the domain www.duorest.pl, used for presenting the offer and enabling the placement of orders and inquiries.

​1.4 Customer – An entity (a natural person, a legal person, or an organizational unit) making purchases or using the Store's electronic services.

​1.5 Consumer – A Customer who is a natural person concluding a contract not directly related to their business or professional activity.

​1.6 Entrepreneur with Consumer Rights – A Customer who is a natural person concluding a contract related to their business activity, but where the content of the contract indicates that it ​is not of a professional nature for that person (e.g., the purchase is not for the purpose of resale).

​1.7 Business Customer – A Customer (a natural person, a legal person, or an organizational unit) making a purchase in direct connection with their business or professional activity.

​1.8 Newsletter – A free electronic service consisting of sending commercial information to the e-mail address of a Customer who has voluntarily consented to it.

2. Placing Orders and Concluding the Contract

​2.1 A sales contract can be concluded through the Store, by telephone at +48 606 507 324, or in person at our showroom at ul. Puławska 228 lok. U5 in Warsaw, during the business hours ​indicated in the "Contact" tab.

2.2 The purchasing process in the Store can be conducted:
a) Quick Online Order:

  • Select a product and its configuration, then click the "Add to card" button.
  • Fill out the form with delivery and invoice details, choose a payment method, and finalize the transaction by clicking the button confirming the purchase with the obligation to pay.
  • You will receive an automatic e-mail confirming the receipt of your order. We will contact you if any details need to be clarified.

3. Prices and Payment Methods

​3.1 All prices in the Store are gross prices (including VAT) and are expressed in Polish Złoty (PLN).

​3.2 Available payment methods:

  • Online Payment: Prepayment.
  • Bank Transfer: A traditional transfer to the Seller's bank account.

​3.3 By accepting the Terms and Conditions, the Customer agrees to receive VAT invoices in electronic form to the e-mail address provided during the order process.

4. Order Delivery

​4.1 We deliver throughout Poland, and the cost is covered by the Seller (delivery is free of charge).

​4.2 Shipments are delivered by the Seller's own transport or by an external courier company on business days.

​4.3 The standard delivery service for goods with a total weight exceeding 30 kg does not include carrying the items into the premises – the courier will deliver the shipment to the front of the ​building.

​4.4 The estimated time to prepare the order for shipment is 1 business days. The courier usually delivers the shipment within 1 business days after dispatch.

5. Returns – Right to Withdraw from the Contract

​5.1 Entitlement: Consumers and Entrepreneurs with Consumer Rights have the right to withdraw from a distance contract within 14 days of receiving the goods, without giving any reason.

​5.2 Notification: To exercise this right, you must submit a clear statement of withdrawal, for example, by sending an e-mail to: contact@duorest.pl.

​5.3 Return Procedure:

  • Return at Customer's Expense: The goods must be sent back to the address: Duorest.pl, ul. Puławska 228, lokal U5, 02-661 Warsaw, Poland, along with a withdrawal form or data identifying the order.

​5.4 Refund: We will refund your payment promptly, no later than 14 days from the day we receive your withdrawal statement. We may withhold the refund until we have received the goods ​back or you have supplied evidence of having sent back the goods. The refund will be made using the same payment method you used for the initial transaction, unless otherwise agreed.

​5.5 Limitations on the Right of Withdrawal: The right to withdraw from the contract does not apply to the purchase of products made to the Customer's individual specifications (e.g., with non-standard dimensions, in a custom fabric) in accordance with Art. 38.1.3 of the Polish Consumer Rights Act.

​5.6 The Customer is liable for any diminished value of the goods resulting from handling them in a way that goes beyond what is necessary to establish their nature, characteristics, and functioning.

6. Complaints and Warranty

​6.1 Non-conformity of Goods with the Contract (for Consumers and Entrepreneurs with Consumer Rights):

  • The Seller is liable for the conformity of the goods with the contract. If a defect is found, the Customer has the right to file a complaint.
  • The most convenient way to file a complaint is through the form on our website or by e-mail to: contact@duorest.pl.
  • The Seller will process the complaint within 14 days.
  • If the complaint is accepted, the Customer may request repair or replacement of the goods. If this is impossible or would entail excessive costs, it is possible to declare a price reduction or withdraw from the contract (if the defect is significant).
  • Detailed rights are governed by the provisions of the Polish Consumer Rights Act.

​6.2 Warranty:

  • Products may be covered by a warranty from the manufacturer or the Seller. The warranty period (typically 3 years, unless the product description states otherwise) and its terms are specified in the product description.
  • The warranty covers material and manufacturing defects. It does not cover mechanical damage, damage resulting from improper use, normal wear and tear, or modifications.
  • Warranty claims should be submitted by e-mail to contact@duorest.pl.
  • In the case of a valid claim, the costs of service transport within Poland are covered by the Seller. The Customer is obliged to securely prepare the product for transport.
  • The warranty does not exclude or limit the Customer's rights arising from the non-conformity of the goods with the contract.

7. Provisions Concerning Business Customers

​7.1 This section applies exclusively to Customers who are Business Customers (excluding Entrepreneurs with Consumer Rights).

7.2 In transactions with Business Customers, the Seller's liability under the statutory warranty for defects (rękojmia) is excluded. Any claims may be pursued solely under the terms of the commercial warranty #6.

​7.3 Business Customers are not entitled to the 14-day right of withdrawal from a distance contract.

​7.4 In the event of an unjustified return of goods by a Business Customer, the Seller is not obliged to accept the goods. After an unsuccessful call for collection, the Seller has the right to charge storage fees or dispose of the goods at the Business Customer's expense.

8. Additional Services and Promotions

​8.1 The Seller provides free electronic services, such as a contact form and a Newsletter. The rules for using the Newsletter are set out in a separate document.

​8.2 Promotions and discount codes in the Store, as a rule, cannot be combined with each other, unless the terms of a specific campaign state otherwise.

9. Final Provisions

​9.1 In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

​9.2 The court competent to resolve disputes with Customers shall be the court with jurisdiction over the Seller's registered office.

​9.3 The Seller reserves the right to amend the Terms and Conditions for important reasons (e.g., changes in applicable law). The changes will take effect 7 days after their publication on the ​Store's website. Orders placed before the changes will be processed according to the previous version of the Terms and Conditions.

10. Montaż produktów 

Produkty wysyłane są w częściach, w kartonie, w związku z czym muszą być zmontowane przez Klienta. Części są doskonale zabezpieczone, aby nie uległy uszkodzeniu w czasie transportu. Montaż jest bardzo prosty, a produkty dostarczane są ze wszystkim, co jest potrzebne do jego wykonania (wkręty, klucze...). Dodatkowo do przesyłki dołączona jest bardzo prosta instrukcja, która opisuje krok po kroku, jak złożyć przedmiot.
